3M won an exclusive contract to sell combat earplugs to service members and shipped millions of military earplugs between 2003 and 2015. Military Earplug Lawsuits began with a whistle blower claiming that 3M and its predecessor, Aero Technologies understood that a design defect existed in the earplugs since 2000. Despite this understanding, 3M continued to sell the same earplugs to the Defense Logistics Agency, which is tasked with supplying equipment to service members.

In answering its lawsuit, 3M acknowledged that Aero had tested the earplugs in 2000. The test revealed the earplugs had no noise reduction benefits. The United States government later took over the whistle blower lawsuit and claimed that 3M and Aero knew the earplugs were too short for proper insertion into the ears, but did not disclose this information to the United States government. 3M Combat Arms Earplugs Purpose

The 3M Combat Arms Earplugs were designed to protect hearing. One side of the earplugs was designed to block out all sound. The other side was created to block loud impulse sounds, like gun fire and explosions, that occurred in combat but to still allow spoken words to be heard.

Rather than block out sound as intended, 3M’s earplugs relied on a design that involved the earplugs loosening in the ear.
